- Order only what you can realistically sell through before December 11, or before your own state's deadline if it's earlier.
- Check your state's rules. Some states have already set earlier dates or their own restrictions.

Is THCA Legal in 2026? The THCA Ban on December 11 Explained
Yes, THCA flower that meets the current federal test is legal to buy during our sale in states that allow it. But the federal rules change on December 11, 2026, and you should understand how before you order.
The current rule: the 2018 Farm Bill
Since 2018, federal law has defined hemp as cannabis with no more than 0.3% delta-9 THC by dry weight. THCA was not counted in that test. That's how high-THCA flower qualified as hemp and could be sold online.
Every batch of THCA flower we sell is tested by a third-party lab to confirm it meets that standard.
What changes on December 11, 2026
A federal law signed on November 12, 2025 rewrote the definition of hemp. It switches to a "total THC" standard that counts THCA alongside delta-9 THC. A September 2026 funding bill moved most of the change from November 12 to December 11, 2026 (Foley Hoag).
From December 11:
- Hemp is measured by total THC, including THCA, at 0.3% by dry weight. Most THCA flower will no longer qualify as federal hemp.
- Finished hemp-derived products are capped at 0.4 mg total THC per container. That affects most THCA and Delta 8 vapes, gummies and pre-rolls.
- Anything that falls outside the hemp definition is treated as marijuana under federal law (Vicente LLP).
One piece already took effect on November 12, 2026: products containing cannabinoids the cannabis plant can't produce naturally lost federal hemp status that day (Hemp Law Group).
State rules can be stricter
Some states move faster than federal law. Illinois aligned with the new federal language on November 12, 2026, and several other states already restrict THCA products. Our checkout won't ship to restricted states, but it's still your responsibility to know your local law.
